DMCA Overview

The DMCA requires online service providers like FansClique to:

  • Respond promptly to valid copyright infringement claims.
     
  • Provide a mechanism for rights holders to request removal of unauthorized content.
     
  • Allow creators to issue counter-notifications when content is wrongly removed.
     

FansClique has established clear policies and procedures to meet these obligations and comply with both U.S. and international copyright law.

 

 

Reporting Copyright Infringement

If you believe that your copyrighted work has been posted on FansClique without authorization, you may submit a DMCA Takedown Notice. A valid notice must include:

  1. Identification of the copyrighted work claimed to be infringed.
     
  2. Precise description of the infringing material and its location on FansClique (e.g., a direct URL).
     
  3. Your contact information (name, address, phone number, and email).
     
  4. A good faith statement that the use of the material is unauthorized by the copyright owner, agent, or law.
     
  5. A declaration of accuracy under penalty of perjury that you are the rights holder or authorized to act on their behalf.
     
  6. Your physical or electronic signature.

Counter-Notification Process

If your content was removed due to a DMCA claim and you believe this was a mistake or misidentification, you may submit a counter-notification containing:

  1. Identification of the removed material and its prior location.
     
  2. Your contact details (name, address, and email).
     
  3. A sworn statement under penalty of perjury that the removal was the result of error or misidentification.
     
  4. Consent to jurisdiction of the Federal District Court in your district (or, if outside the U.S., the court where Meritearn LTD operates) and acceptance of service of process from the claimant.
     
  5. Your physical or electronic signature.
     

Once a valid counter-notification is received, FansClique may reinstate the removed material unless the claimant initiates legal proceedings within 10 business days.

 

 

Repeat Infringer Policy

FansClique enforces a zero-tolerance policy for repeat copyright infringement.

  • Accounts of repeat infringers may be suspended or terminated.
     
  • Associated content may be permanently removed.
     
  • Users in violation will not be eligible to rejoin under alternate accounts.
