DMCA Overview

Under the DMCA, content platforms like FansClique are required to respond to claims of
copyright infringement and provide a clear process for copyright holders to report unauthorized
use of their intellectual property. FansClique takes these responsibilities seriously and has
established a formal process for managing DMCA takedown requests in accordance with both
U.S. law and best global practices.

direct URL link.

complained of is not authorized by the copyright owner, its agent, or the law.

that you are the copyright owner or authorized to act on behalf of the owner.

Counter-Notification Process

If you believe that content you posted was wrongfully removed due to a DMCA claim, you may
file a counter-notification. This notice must include:
1. Identification of the material** that was removed and the location where the material
appeared before it was removed.
2. Your contact information**, including your name, address, and email.
3. A statement under penalty of perjury** that you have a good faith belief that the material was
removed as a result of mistake or misidentification.
4. Your consent to the jurisdiction** of the Federal District Court for the district in which your
address is located (or if outside the U.S., to the jurisdiction of the Federal District Court where
FansClique is located), and your agreement to accept service of process from the party who
submitted the original DMCA claim.
5. Your physical or electronic signature**.
Upon receipt of a valid counter-notification, FansClique may reinstate the removed content
unless the original complainant files a lawsuit against the user within ten business days.

Repeat Infringer Policy

FansClique has adopted a zero-tolerance policy for repeat copyright infringers. If a user is found
to be repeatedly infringing upon others' intellectual property rights, FansClique reserves the
right to terminate their account and remove all associated content in compliance with the DMCA
and relevant global copyright laws.

While the DMCA is a U.S.-based law, FansClique ensures compliance with international
copyright standards, including those in Africa and other regions. We follow best practices for
global copyright enforcement by:
1. Respecting the **Berne Convention** and other international treaties governing intellectual
property rights.
2. Aligning with local copyright laws in African countries to protect the rights of African creators
and global content providers alike.
3. Ensuring that all users, whether based in Africa or elsewhere, have access to a fair and
transparent process for reporting and resolving copyright disputes.

Protecting African Creators and Global Users

FansClique, with its roots in Africa, places special emphasis on protecting the intellectual
property of African creators. We recognize the unique challenges faced by creators in emerging
markets and ensure that their work is treated with the same respect and legal protection as
